1. An Action was commenced in the Ontario court seeking damages on behalf of all persons whose homes were flooded in December, 2006, who live in the City of Toronto. These residents reside between Birchmount and Kennedy Roads to the east and west; and between Finch and Sheppard Avenues, as set out in the map below. (Click for Large map)Excepted areas include: The Tam Oshanter Golf Course, Tam Oshanter Park, Agincourt Mall, and Highland Heights Park. 2. A Certification Motion in this matter is scheduled to be argued on July 29 and 30, 2010, at the Court House in Courtroom Five, at Osgoode Hall, 130 Queen Street West, Toronto, Ontario. It will be determined by the Justice hearing the Motion if this matter ought to proceed as a Class Proceeding. 3. The Statement of Claim asserts a claim for damages for negligence and seeks an Order that the City of Toronto pay to the members of the Class compensation for flooding victims. 4.
